OpenAI Challenges Delhi High Court's Jurisdiction in ANI Copyright Lawsuit
OpenAI, the creator of ChatGPT, is contesting the jurisdiction of the Delhi High Court in a copyright lawsuit filed by the news agency ANI. ANI alleges that OpenAI used its content without permission to train the ChatGPT AI model.
OpenAI argues that the Delhi High Court lacks jurisdiction over the case, emphasizing that the company has no physical presence in India. OpenAI highlights that it does not have an office or permanent establishment in the country, and its servers containing training data are located outside India. Furthermore, OpenAI asserts that complying with ANI’s demand to remove its content from ChatGPT’s training data would violate U.S. legal obligations requiring the preservation of such data.
